Asked to analyse the dispute (a party valued and claimed 130m), and identify the root causes and the disputed issues, and provide alternatives for urgent resolution.
Using my experience in such matters, I analysed the facts from various angles: business implications; performance; services delivered; and contractual matters (consulting with relevant experts – they are important!). Furthermore, this necessarily involved numerous interactions with the parties, Boards and the CEOs
Within record time, the key resolution issues were identified; negotiations initiated, and proposed solutions presented to the CEOs. The result: the threatened dispute was dropped by both parties, the relationship retained, and a new business initiative was entered into, as part of the settlement and the future!
